1. Introduction

This FertiGuide application is created & operated by Merck Serono Middle East FZ-LTD. With this data protection declaration we explain to you which personal data is processed for which purposes, Data protection declaration as of: 1st December 2021. By installing the application, you are providing consent to this Privacy Statement.

2. Which data does the application process and for which purpose?

2.1. Information Accessible Only By The Nurse You Interact with (Merck has no access to):

2.1.1. Signing Up and Log-in

As the resources we provide on this application is legally restricted to those who are using at least one Merck product, we require you to register and log-in. This will allow you to enable your patients to access the application (by sending them their unique access code) – and to track their data to better support them in the treatment journey.

In order to Sign Up, The application then stores your name, email address, year of birth.

2.1.2. Information Needed To Use The Application Features

This application is intended to provide you with resources and features to support you throughout your treatment journey. For doing this, it will store:

  • - For the fluid tracker: Your weight, fluid intake time and quantity, wake up & bed time
  • - For medication reminders: Name of the medication you are using, dosage and timing
  • - For fertility tracking: Menstruation start/end dates
  • - For general interaction with the nurse: Last log in date
2.1.3. Information Not Accessible By Either The Nurse Or Merck

- Your password.

- We use TrueDepth API technologies (ARKit, with automatic estimation of the real-world directional lighting environment) to identify any Merck fertility products pointed towards the camera. The only use of this information is to provide valuable user features. None of the information collected by the TrueDepth API ever leaves the user's device. We do not share information with third parties, do not store or process in any other way the data which we accessed and used via TrueDepth API. 2.2. Information Accessible By Merck:

This application uses Google Analytics (a web analysis service provided by Google Inc. to store analytical cookies on your device). This means that technical information about the application usage is transmitted to Google. It will not be merged with other Google data.

The purpose of using Google Analytics is to improve the technical platform of the application. The following information is captured through Google Analytics anonymously (without the identity of the user):

  • - Time spent on the application (total, average)
  • - Total sessions (how many times the app was used)
  • - Country
  • - Device type (Android or iOS)
  • - Number of crashes

The application itself also collects data regarding traffic in the application and the available resources (Videos and Articles). This is for the purpose of keeping the posted information meaningful & interesting to the users.

3. Data not collected by the application

The application doesn't collect any browsing history, or any other activities you are doing on your phone. It doesn’t install cookies, doesn’t track your location, doesn’t interact with any of the other mobile features e.g. photos, and doesn’t install any cookies.

4. Recipients of personal data; data transfer to third countries

4.1. Data Transfer

Servers for this application are located in UAE. Personal data is not transferred out of UAE.

4.2. External Service Provider

We partner with service providers who support us to develop and support this application. The reason is that applications require technical support and administration which is a task that cannot be done by Meck’s technology team. As stated above, Merck doesn’t have access to your personal data. These service providers process data only in accordance with the instructions and under the control of Merck and exclusively for the purposes described in this privacy policy.

5. Data retention

We store data for as long as necessary for the provision of the service to you. Your data will remain in the application unless you request it to be deleted.

6. Data protection rights and contact

6.1. General Rights

You can request information about the data stored about you and have the right to receive the data provided by you in a common and machine-readable format. Furthermore, in justified cases, you may also request the deletion, correction or limitation of the processing of your data.

6.2. Right To Be Forgotten

You can contact your nurse requesting to deactivate and/or delete your data. The nurse will contact Merck’s team for the account to be deactivated and/or data to be deleted.

7. Legal obligations and legal enforcement

In some cases we are under a legal obligation to process personal data. A typical example is the processing within the scope of the so-called pharmacovigilance, i.e. the obligation to investigate and share data when potential side effects of drugs become known.

Where required, we can also use your data to enforce our third party rights (such as copyright infringements).

8. Adverse Events

If we become aware of potential cases of adverse reactions to one of our products, we are required by law to document and share the relevant information, including personal information with authorities worldwide and, where necessary for further assessment, to contact the reporting parties.
